By Mamadou Dem Bintou Jallow, an employee of CFAO alongside one Baboucarr Gai yesterday appeared before Principal Magistrate Lamin Mbaye of the Banjul Magistrates’ jointly charged with “Conspiracy to defraud contrary to Section 292 of the Criminal Code, laws of The Gambia.” According to the particulars of offence on count one, the aforesaid persons between the months of October 2013 and July 2014 at Banjul and diverse places within the jurisdiction of the Gambia conspired within themselves to defraud CFAO company of an amount of four million, two hundred and eighty eight thousand, six hundred and eighty eight dalasis ( D4, 288,688.00) being the property of CFAO Motors Gambia Limited, thereby committed an offence. On count two, Bintou Jallow is accused of stealing by clerk or servant contrary to the laws of the Gambia. The particulars of offence states that the accused between the Months of October 2013 and July 2014 in Banjul and diverse places within the jurisdiction of the Gambia stole from the Company an amount of five million, one hundred and fifty one thousand, Six hundred and twenty five dalasis (D5,151,625), being the property of CFAO Motors Gambia Limited, thereby committed an offence. Mr. Baboucarr Gai is accused of ‘theft’ under count three and the particulars of offence states that “Baboucarr Camara for that you did, betweens the months of October 2013 and July 2014, at Banjul and diverse places within the jurisdiction of the Gambia, you stole four million, two hundred and eighty eight thousand, six hundred and eighty eight dalasis (D4, 288,688.00) being the property of CFAO Gambia Ltd, being monies transferred to your account for the purpose of purchasing hard currency, thereby committed an offence.” Both accused persons pleaded not guilty as charged and were subsequently granted bail in the sum of six million dalasis each. They are each to provide a Gambian with a valid Identity Card to be deposited with the court’s registrar. The accused persons were further ordered to deposit original title deeds of properties situated within the Greater Banjul Area and West Coast Region respectively. They should also deposit their travelling documents with the court registrar. Prior to the granting of bail, police prosecutor Almameh Manga applied for the court to grant them a fortnight adjournment to enable them call their witnesses. Lamin Camara, counsel for Baboucarr Gai did not object to the application for adjournment, however he urged the court to admit bail to the accused persons pursuant to section 99 of the Criminal Code, Laws of The Gambia. He added that the charges meted on the accused persons are bailable offences. “We therefore crave the court indulgence to grant bail to the accused person,” he urged.
