The President proclaimed a state of emergency on 26th March 2020 and subsequently under the Emergency Powers Act he made several regulations known as Emergency Powers Regulations with a view to safeguarding public safety and public healthy even though these regulations may contravene certain fundamental rights and freedoms.

Foroyaa is publishing all the regulations so that the public will know the restrictions in place. In this edition we publish the Essential Commodities Emergency Powers Regulations, 2020 (Legal Notice No. 10) as amended by Legal Notice No. 16.

EMERGENCY POWERS ACT

ESSENTIAL COMMODITIES

EMERGENCY POWERS REGULATIONS, 2020

IN EXERCISE of the powers conferred on the President by section 3 of the Emergency Powers Act, the Regulations are made.

1. Citation, and duration

(1) These Regulations may be cited as the Essential Commodities Emergency Powers Regulations, 2020 (No. 1).

(2) These Regulation shall apply throughout The Gambia.

(3) These Regulations shall subsist until the end of the Proclamation of public emergency issued on the 26th March 2020.

2. Price Control of Essential Commodities

(1) The wholesale and retail prices of all essential commodities are hereby frozen to the price they were sold in the open market as at 18th March 2020 as specified in the Schedule to these Regulations.

(2) A person shall not sell essential commodities beyond the price prescribed in sub-regulation (1).

(3) In these regulations, essential commodities are –

(a) Rice,

(b) Maize;

(c) Millet

(d) Flour;

(e) Sugar;

(f) Milk

(g) Bread

(h) Chicken;

(i) Eggs;

(j) Meat;

(k) Fish;

(l) Cooking oil;

(m) Potatoes;

(n) Onions;

(o) Tomato paste;

(p) Cement;

(q) Soap; and

(r) Hand sanitisers.

(4) In these Regulations, “open market” means and unrestricted market with free access consumers and vendors as designated by a Local Government authority.

3. Hoarding

(1) A person shall not hoard any essential commodity in any way, shape or form.

(2) A wholesaler or retailer of an essential commodity or a person employed by him or her shall not –

(a) Refuse to sell such commodity or give any other indication which could reasonably lead the purchaser to believe that he or she has not got the commodity.

(b) Offer to sell the commodity subject to a condition requiring the buying of any other goods or the making of any payment in respect of any service, or subject to any other condition except the payment of price forthwith or take delivery within a reasonable time.

4. Rationing

A vendor of an essential commodity shall be entitled to refuse to sell to a single purchaser, quantitates he or she reasonably believes are beyond the purchaser’s current needs.

5. Prohibition of export

(1) Person shall not export –

(a) Any essential commodity; or

(b) Any petroleum and related products, Outside the Gambia

(2) (a) Not depart after 3 p.m. daily; and

(b) Before departure obtain a clearance certificate from the Police indicating his or her destination..

6. Essential commodities Control Committee

(1) There is established by these Regulations, the Essential Commodities Control Committee to supervise the enforcement of these Regulations.

(2) The Committee shall consist of – .

(a) The Permanent Secretary, Ministry of Trade, Industry, Regional Integration and Employment;

(b) The solicitor general and legal Secretary;

(c) The Director General, State Intelligence Service;

(d) The Inspector General of Police;

(e) The Commissioner General, Gambia Revenue Authority;

(f) The Chief Executive Officer Gambia Chamber of Commerce and Industry;

(g) The Executive Secretary, Gambia competition and Consumer protection commission; and

(h) The President, Consumer Protection Consortium of the Gambia.

(3) The Committee shall appoint Inspectors and issue them with clearly identified identity cards.

(4) The Inspectors shall carry their identity cards at all times in the course of executing their duties.

(5) An Inspector may without prior notice and at any time –

(a) Enter and inspect any premises in the occupation or under the control or possession of any wholesaler or retailer;

(b) Examine any books, accounts or other documents relating to the stock levels and price of a wholesaler or retailer;

(c) Require a wholesaler or retailer to furnish any information in relation to his or her stock levels and prices; and

(d) Do any other thing necessary or expedient for the proper discharge of his or her functions.

7. Offences and penalties

(1) A person who breaches a provision of these Regulations commits and offence and it liable on conviction to a fine of five hundred thousand dalasis.

(2) A vendor or an owner of a business selling essential commodities who breaches a provision of these Regulations may have his, her or its trade licence-

(a) Suspended after his or her arrest until the end of his or her trial and

(b) Revoked by the court after conviction.

(3) a person who is convicted of an offence relating to regulation 5 for a second time shall have his or her goods forfeited to the state

(4) the Inspector General of Police may requisition and premises or warehouse in The Gambia for the purpose of storing any goods seized pending the trial of the owner or carrier of the goods or after its forfeiture to the state.

(5) the goods forfeited to the state shall be surrendered to the Minister responsible for trade.”
