Justcice Eammuel Amadi of the Special Criminal Division of the High Court on 
Thursday 21st May 2015 has again threatened to close the case of former minister of presidential affairs, Momodou Sabally,
He said he will close the case involving the Former Secretary General, Head of Civil Service and Minster for Presidential Affairs if the prosecution fails to bring their last witness to give his testimony before the court in the next adjournment date.
“Even this means I will be sent back to Nigeria – I will go home. I am not going to adjourn the case again because of your witness who is in the United States and does not appear in court.”
Earlier in his submission the Director of Public Prosecutions SH Barkun said he is left with his last witness Alasana Ndoye who works in the United States. He said however his witness is not in the country to give his testimony to the court and he applied for an adjournment to allow his witness to travel to the Gambia. He informed the court that three summon letters have been sent to him in U.S but he could not come still as he is working with a private company in the U.S.
DPP told the court that he doesn’t want to jeopardize with the work of his witness in the U.S.
In his response the trial judge Justice Amadi said “You don’t want to jeopardize his work and you are jeopardising this man (Mr. Sabally) every day since last year; and why didn’t you write to him since in the middle of this case?”
Defence counsel Mr. Antouman Gaye also submitted to the court that he is not surprised with this request made by the prosecution for an adjournment. He went on to inform the court that apart from Alasana Ndoye there are two other witnesses on the list of witnesses for the prosecution.
In his submission objecting to the application filed by DPP Barkun, Lawyer Gaye told the court not that he is only opposed to the application for an adjournment but he is as well urging the his the court to carry out the warning he made yesterday of closing the case. This is just after 24 hours after you made this warning and today we heard similar information.
This case has been in court for a period of 7 months since the 22nd of October 2014 Gaye told the court.
Justice Amadi finally allowed for a last adjournment till 4th of June 2015 at 2: 30pm for prosecution to present their last witness, cautioning that if the witness fails to appear he would close the case.
