IS A SIT DOWN PROTEST UNLAWFUL?

The Constitution of The Gambia in section 25 makes it a right for every person to engage in peaceful assembly and this includes sit down protest. The Public Order Act does not bar this and there is no need to seek permit for this.

The Public Order Act gives power to the Inspector General of Police to control procession (under section 5) and the use of a public address system (under section 6). Hence any person or group of persons who want to engage in a procession or use a public address system must obtain a permit from the Inspector General of Police in these circumstances.
