The economic crimes and theft trial involving one Alhagie Kebbeh accused of embezzling funds and stealing rice that was intended for Covid-19 relief distribution continued.
Bakary Drammeh, a policeman working at the Manjai Police Station in the Criminal Investigation Department (CID) commenced his testimony before the court. He said he recognized the accused person in the dock. When asked how he recognised the accused, the witness testified that on Sunday, 28th May 2023, officers from the Fraud Squad went to his residence at Paradise View and arrested him (Alhagie Kebbeh). He was escorted to the police headquarters for further investigation. He said the arresting team included himself, Edrisa Drammeh and Saidy.
At this point, Counsel Kadijatou Jallow entered the courtroom and asked the name of the witness testifying. She was informed that the name of the witness was Bakary Drammeh. She informed the court that the witness’ name was not part of the listed names of witnesses.
The Director of Public Prosecutions Abdul Maita Yusuf said they have regularised the witness list. Counsel Kadijatou Jallow argued that they are not served with the amended witness list. She submitted that section 175 of the Criminal Code makes it mandatory for the prosecution to serve the defence the witness list.
The presiding judge, Justice Ebrima Jaiteh said the issue was an administrative lapse because the DPP had done what was expected of him. He added that he cannot hold the prosecution accountable for the lapse.
The case was adjourned to enable the process server to serve Counsel Jallow.
