WHAT SHOULD THE NATIONAL ASSEMBLY MEMBERS LOOK FOR IN CONSIDERING THE SECOND READING OF THE CONSTITUTIONAL PROMULGATION BILL 2024?

Section 101 subsection of the Constitution states:

“(2) No Bill, other than a Bill referred to in subsection (5), shall be introduced into the National Assembly unless it is accompanied by an explanatory memorandum setting out in detail the policy and principles of the Bill, the defects which it is intended to remedy and the necessity for its introduction.”

Hence any Constitution Promulgation Bill must be accompanied by an explanatory memorandum detailing the principles and objects of the Bill. This is what will determine the vote that will be cast by a National Assembly member if the Bill is to proceed to the next stage of the law making process after the second reading.

Eventually the Gambian voter will have to decide whether to accept at a referendum what the National Assembly finally adopts to put before them.
