The answer is in the negative. Section 25 of the Constitution guarantees freedom of political association as a right. Section 100 Subsection (2)(a) of the Constitution adds:

“The National Assembly shall not pass a Bill-

‘‘(a) to establish a one party state;’’

Section 104 Subsection (3) of the Elections Act, sums it up by asserting that:

 “The number of political parties shall not be limited by law and every citizen of The Gambia shall have the right freely, to choose whether or not, he or she becomes a member of a political party and which party he or she supports.”

Hence, the Law does not aim to restrict the right of any Gambian to be founding and joining parties, and hence no law should be enacted which aims to restrict such a right.
