Foroyaa has indicated that any allegation of unlawful arrest and detention should not be politicised. Section 19 of the Constitution has given guarantees for the right to personal liberty and has indicated when, why and how long a person can be arrested and detained and taken to court.

Any person who is arrested and detained without any respect to due process could be considered to be in violation of the Constitution. Section 37 gives power to the High Court to consider cases of violation of human rights and provide redress. Any person whose human right is being violated can proceed to the High Court for redress. This is how matters stand.
