without trial, but added that families of victims have the right to take up matters with the courts for redress. This is not what is expected of the executive. The Constitution has made it abundantly clear that the executive and its agents should not be human rights violators. They should be human rights defenders and upholders. This is put in black and white under Section 17 of the constitution. It is therefore the duty of the executive and its agents to protect human rights. They should uphold human rights without fear or favour, affection or illwill. ]]>
