Taranga FM Manager’s Trial: Defence to File ‘No Case to Answer’

Barrister Combeh Gaye-Coker, who is representing Mr. Abdoulie Ceesay,Alhaji Abdoulie Ceesay, Manager Teranga FM

station, has told the Banjul high court presided over by Justice
Simeon Ateh Abi that she wish to filed a ‘No case to Answer’ for her client.Mr. Ceesay was indicted on 6 counts of ‘Sedition’ and 1 count of
‘Publication of false news’.

When the case was called, the Director of Public Prosecutions (DPP) H.S
Barkun announced his representation for the state, whilst lawyer
Antouman Gaye, Combeh Gaye-Coker and Segga Gaye appeared for the
accused.

“Having reviewed the evidence adduced by the prosecution witnesses, we
have decided to file a ‘no case to answer’. Subject to the convenient
of the court, we can write or do it orally,” submitted  defence
counsel Gaye-Coker.

At this stage, the accused person, who was standing in the dock,
complained that he is sick and wants to sit down. The court granted
him the request to sit down.

Mrs. Gaye Coker told the court that she had filed a bail application
for the accused dated 25th of January, 2016 and that the state has
been served. She disclosed to the court  that she was served in
court with an affidavit of opposition which is not dated and that as
such it is incompetent as the rules on affidavit are very clear.

At this juncture, the DPP Barkum interjected and told the court that
his copy is dated and that he can give it to the defence counsel and
which he did.

Subsequently, Justice Abi adjourned the case to Monday, February, 2016
and ordered that each party would at the next adjournment date argue 25 minutes on the bail application and 10
minutes to reply on points of law. He also ruled that the ‘no case to
answer’ be filed before the 2nd February, 2016 and gave 3 working days
to the prosecution to reply to it.
