Should False News Be Criminalised?

There is no human being who does not make the error of spreading rumours which may sometimes be false. Politicians as well as journalists are often tempted to say or report things which may be questionable. This is why rejoinders are entertained by Newspapers to enable the public clarify wrong notions.

In a democratic society, crimes are actions done that are injurious to others which have no remedy through proportionate reaction to prevent the intended injury from being inflicted or the employment of civil suit.

 

Information could easily be rebuffed and any injury it causes after being rebuffed could be remedied through a civil suit. Hence it is questionable whether the retention of false news in the criminal code will advance the cause of freedom and justice or promote more impunity under the guise of law enforcement.
