The Banjul High Court is to deliver a ruling on the injunction filed
by the counsel for one Jambantang Ceesay, plaintiff, who has sued the Sheriff Division for wrongfully taking his property from him.This was announced yesterday, Monday, 4 May, at the proceeding
presided by Justice Basiru Mahoney of the Banjul High Court.
When the case was called, Lawyer Lamin S. Camara announced his
appearance for the plaintiff, in absentia, while lawyer Ida Drammeh
represented the second defendant, Omar Jawara. The Sheriff was not
represented in court.
Lawyer Camara formally adopted the brief of injunction filed on behalf
of the plaintiff.
Ms. Drammeh applied for the injunction to be lifted because the court
lacks the jurisdiction but later abandoned the application after the
plaintiff’s lawyer said she cannot make a preliminary objection
without filing her brief. She decided to adopt the brief which she
filed against the injunction and demanded a fine for the late filing
of brief by the plaintiff.
At this juncture, Lawyer Camara applied for an adjournment because he
has a matter at the Court of Appeal but it was objected to by Ms.
Drammeh, who argued that the court should not adjourn the matter.
Lawyer Camara further submitted that the lawyer of the second
defendant needs to argue on points of law and not the other way round.
He calls for the right to reply to the brief and of which he would
need time to do.
The court, however, ordered for the plaintiff to pay a fine of Five
Thousand Dalasi (D5, 000).
Subsequently, the matter was adjourned to Tuesday, 12th May 2015, for
ruling on the injunction filed by the plaintiff.
The lawyer of one Mr. Ceesay, the plaintiff, who is a resident of Faji
Kunda, has summoned the Sheriff for allegedly forfeiting a landed
property belonging to him as collateral to his brother’s business
partners without his knowledge.]]>
