PUBLIC NOTICE FOR GOVERNANCE IS ISSUED THROUGH THE GAZETTE

49

An authority with powers to give order or make proclamation must do so through publication in the Gambia Gazette with reference made to the relevant section of the law. It is in the public domain that the minister of foreign affairs has resigned. No one has heard or seen any statement issued by the executive indicating a vacancy.

It is significant to note that section 71 of the Constitution states:

“The office of a Secretary of State shall become vacant-

(a) on the assumption by a person of the office of

President.

(b) on his or her appointment being revoked by the

President.

(c) on his or her death or resignation.

If the minister of foreign affairs has resigned that fact should be published in the Gambia Gazette; there is no provision in the Constitution for an outgoing or incoming minister. The office of the minister is either occupied or vacant. Hence rumours could only be avoided if the Constitution is respected and executed. Foroyaa has been informed that Mr. Mamadou Tangara has resigned. It is left to the government to give an official version to establish the fact.
