IS IT NECESSARY TO CONTINUE WITH CERTAIN CASES IN COURT?

There are certain cases which started under the former regime that are still proceeding in court. The conviction of the accused in these cases would tantamount to an infringement of a fundamental right of the accused.

In short it is a fundamental right to petition the president under section 25(f) of the Constitution and to convict someone under section 114 of the Criminal Code when he/she exercises that right would constitute an infringement of that right. The former government had no regard for the Constitution.

Consideration should be given in speeding up the review of such cases.
