The name National Intelligence Agency (NIA) cannot be changed to State Intelligence Services (SIS) without constitutional amendment. The Attorney General should make this known to the cabinet.
Section 191 of the Constitution states:
“(1) There shall be a National Intelligence Agency which shall be under the command of the President. ·
(2) Subject to any Act of the National Assembly and the provisions of this Constitution, the National Intelligence Agency shall be governed by the National Intelligence Agency Act.”
The Constitution has made it mandatory for the name NIA to be utilized in establishing the institution as well as in the enactment of any statutory provision governing the operation of the institution. Unless the Constitution is amended, the name State Intelligence Services (SIS) cannot replace National Intelligence Agency (NIA).
