Medical Doctor who goes by the name Ramatoulie Drammeh on Monday 23rd June gave evidence in a Gender Based Violence case that involves a male survivor. She testified that victim acquired anal injury through sexual intercourse with accused Ass Malick Njie. The case is before Justice Ebrima Jaiteh of the Banjul High Court.
The prosecution has called upon three witnesses in court and medical doctor testimony made it four.
Ass Malick Njie the accused is charged with rape contrary to section 3(1)(a) of the Sexual Offence Act 2023 and punishable under section 4(1)(a)(III)(bb) of the Sexual Offence Act. The particulars of Offence is Ass Malick Njie about the 5th of February 2022, in Kanifing Municipality has intentionally and coercively has sexual intercourse with a male Minor.
Witness Ramatoulie Drammeh testified to the court that during an interview with victim he told her that he had an encounter with accused Ass Malick Njie and her examination also showed that fact. “The victim revealed to me that he was engaged in sexual intercourse with the accused, and when I conducted an examination.”
She revealed that during interview with child victim he told her accused used to gave him cigarette before having sexual activity with him. According to her, the medical report is a clear testimony of gender based violence against the child victim.
And the prosecuting counsel M.Singateh issued the report and showed it to witness and she admitted that the report was accurate because it contained her signature.
Without an objection from defence lawyer C.U. Udema state counsel tendered the medical report in court as evidence and Judge marked it has exhibit P4.
She explained to the court that the child victim was ill due to gender based violence and sexual exploitation.
In cross examination by the defence counsel, he asked the witness whether she had a specialization in area. She responded that during the course of the incident she was just a medical doctor with no specialization in that area but currently she is undergoing her specialization in gynecologist.
And she asked how did the doctor know whether the child acquired anal injury due to sexual activities. The doctor said the injury on the child victim occurred during sexual activities, and her examination findings proved that.
Accused lawyer asked witness whether it is only through anal intercourse that a person can have anal injury. She responded that anal injury can occur during constipation, diarrhea but she made it cleared that anal injury of child victim was caused through sexual intercourse.
Lawyer Udema also asked whether the doctor had found semen on the alleged victim. The witness responded to her that no semen was found on the victim, but examination findings proved that child victim was sexually abused.
She furthered that severity of an injury can be determine depending on time frame injured reach health center. “Intense of injury could be two, three days, weeks that all will determine it severity.”
The case has been adjourned to 8th July 2025 at 10:30.
