The High Court in Banjul, presided over by Justice Sidi Jobarteh, on Tuesday, 22nd July 2025, struck out the bail application filed on behalf of Hanna Magbujor Isaiah, also known as “Treasure,” the Nigerian national accused of human trafficking and sexual exploitation.
The court ruled that the application, filed by defence lawyer Hajum Gaye, was procedurally flawed and therefore could not be entertained. Justice Jobarteh held that bail in a substantive criminal matter should be sought by a motion and not by originating summons.
The judge emphasized that given the seriousness and complexity of the case — which is currently before the court — the legal procedure must be strictly adhered to. “This is not the appropriate process. Counsel ought to have brought a motion for bail, not an originating summons,” Justice Jobarteh stated.
The application, brought by Gaye, asked the court to admit her client to bail on reasonable terms pending the hearing and determination of the indictment against her. However, State Counsel M. Jammeh raised a preliminary objection, arguing that the affidavit in support of the summons was “incurably defective” because the person listed as the deponent was not the one who actually signed the document.
In her ruling, Justice Jobarteh agreed with the objection, noting the procedural defects in the application. She consequently struck it out and advised defence counsel to file a proper motion for bail in accordance with the law.
Hanna Magbujor Isaiah, who has pleaded not guilty to six serious charges, including trafficking in persons and importation of persons for the purpose of prostitution, remains in custody. The charges, all criminal offences under Gambian law, carry significant penalties if proven.
The case is scheduled to continue today, Wednesday, 23rd July 2025.
