This question was put to Halifa Sallah and the following is what he said in response.
The Constitution of the Republic of The Gambia and the National Audit Office Act command that no person can assume the office of Auditor General without taking the prescribed oaths.
Section 158 subsection (2) states: “Before assuming the functions of his or her office, the Auditor-General shall take and subscribe the prescribed oaths.”
Furthermore, section 12 of the National Audit Office Act states: “A person appointed as Auditor General of The Gambia shall, before assuming the functions of his or her office take and subscribe before the President, the Oath of Allegiance and the Oath for the Due Execution of Office.”
All authorities of the land should bear in mind that to disregard the Constitution and the laws of the land amounts to impunity. That is how matters stand.
