Arson Case Transferred to Special Criminal Division

Magistrate Nche Blessed of the lower court in Banjul yesterday, 13th
January, 2016 ordered for the single count charge of “Arson” leveledagainst one MomodouSalieu Bah be transferred to special criminal
division of the High Court of The Gambia as it has the proper
jurisdiction to try the case.
Prior to the mentioning of the matter and subsequent transfer,
Corporal 2875 Njie applied for the matter to be moved to the said
court pursuant to section 62 of the Criminal Procedure Code (CPC).
In her ruling, Magistrate Blessed said the offence alleged against the
accused is punishable with life imprisonment. She then ordered the
case file to be taken to the office of the Master of the superior
court for re-assignment, adding that the accused be kept in custody
pending his appearance to the proper jurisdiction.
The particulars of offence states that the aforesaid person “on or
about the 5th of December 2015 at Bakindick Village, lower Numi
District, North Bank Region, and diverse places of the Republic of The
Gambia, set fire on a groundnut heap belonging to one Momodou Salieu
Jallow, thereby committed an offence.”
However, the 28th year old has pleaded not guilty as charged and
was consequently remanded in custody.
