ARE WAR CRIMES BECOMING DANGEROUS TO COMMIT?

The ICC has been accused of weakness and biasness in their identification, pursuit and trial of alleged perpetrators of genocide, war crimes and crimes against humanity, especially crimes committed or allegedly committed under the direction of the permanent members of the security council.

However recent developments where countries are being brought before the international court of justice on issues of genocide are leading to decisions that could well provide a solid foundation for identifying war criminals regardless of whether they are from weak or powerful nations.

Hence generals winning battles all over the world must bear in mind that their governments could put them in hot soup if they are motivated by their governments to commit genocide against people.

In order to save the ICC from its current stigma, the members should sit again to look at the convention and examine how to link the credible moves of the ICJ in the Rohingya case pursued by Gambia, the Palestinian case pursued by south Africa and the Ukraine case pursued by Ukraine as preliminary cases to put the ICC into action.
