The trial involving Sheikh Muhideen Hydara and Buyeh Touray, the Caliph General 
and Alkalo of Darsilameh Sangajor respectively, was deferred yesterday, 19th January, 2015 at the Brikama Magistrates’ Court due to the absence of the accused persons and the late service of defence’s written brief to the prosecution.Appearing before Principal Magistrate Omar Cham of the Brikama Magistrates’ Court, the police prosecutor Chief Inspector Camara announced his representation of the state whilst Lawyer Lamin Mboge appeared for the accused persons.
Lawyer Mboge informed the court that his clients were not in court because the matter was for mention to prove the filing and serving of defence’s address to the prosecution.
“We have filed our defence today and served the prosecution. As a result, we are applying for adjournment,” said Mboge.
The trial magistrate said in a criminal trial accused persons should not be absent in court with or without proceedings, adding that it was based on that reason that their bail application was granted. He therefore warned that the bail of the accused persons will be revoked if the trend continues.
The defence counsel admitted that he was wrong but assured the court that the accused persons will be in the next proceeding.
Chief Inspector Camara, at this juncture, confirmed to the court that he has been served with the brief of the defence on that Monday, adding that he will reply to the submission on the next adjourned date.
The matter was adjourned to 27th January, 2014 at 12pm for adoption of briefs.]]>
