The case of Modou Lamin Bojang who sued his ex-employer Africa Muslim Agency for wrongful termination of service could not proceed yesterday 9 March, 2016 at the Kanifing Industrial Tribunal.
The case was adjourned on 17 February, 2016, to give the parties (Modou Lamin Bojang and The Gambia Muslim Agency) the opportunity to negotiate an out of court settlement before the next proceeding scheduled date, yesterday.
However, the tribunal, chaired by Madam Isatou Janneh, further ruled then that if both parties fail to come to terms before the next adjourned date (yesterday), the matter will enter judgment.
Both parties were in court yesterday together with their legal representatives. However, information from the tribunal indicates that the tribunal’s chair had fallen ill and as a result the case was adjourned till 23 March, 2016 at 2pm for the tribunal to decide the fate of the case.
According to the statement of claim, the plaintiff (Modou Lamin Bojang) is claiming from Africa Muslim Agency pay the sum of D20, 160.00 being six months’ salary for unlawful termination, the recovery of the sum of D7,237.00 being 56 days leave arrears for 2009, 2010 and 2014, Costs and the 25% interest from the date of filing to the date of judgment.
According to the particulars of the claim, Modou Lamin Bojang was working for the Gambia Muslim Agency as a driver for five years.
