The “Alkalo” of Babylon in Kombo North, Mr. lamin Jargue was granted
bail on Monday 14 September 2015 after spending two weeks in remand
following his indictment by the state on one count charge. The presiding
magistrate Hilary Abeke of Brikama Magistrates’ Court finally granted
the accused bail when the prosecuting officer, Touray did not make any objection to the bail application filed by the defence counsel.
His counsel, Mr Borry Touray had applied to the court for Mr
Jarjue to be granted bail after spending two weeks in remand. Defence
counsel Touray submitted that his client is shouldering a lot of family
responsibility and has three wives.
He further submitted that the offence for which he is charged with is a
misdemeanour, and secondly it is a bailable offence. He urged the
court to grant his client bail. He argued that since the arrest of the
accused “the State has had enough time on their side to do
investigation”.
According to the statement of offence, Mr. Lamin Jarjue is charged
with disobedience to lawful order contrary to section 116 of the
Criminal Code Cap 10 Vol 111 Laws of The Gambia. The particulars of
offence is that Lamin Jarjue sometime in the month of August 2015 at
Makumbaya Village, Kombo North, West Coast Region in the Republic of
the Gambia, disobeyed the lawful orders of the District Chief of Kombo
North, thereby committed an offence.
The case was adjourned till 28 September, 2015. Sources
informed this reporter that the prosecution may file another charge
against Mr. Lamin Jarjue on the adjourned date.
