The Brusubi Magistrates’ Court sitting at the Bundung Courts Complex has granted bail to two men accused of engaging in homosexual conduct, setting strict conditions including the submission of property title deeds worth a total of one million dalasis.
Presiding Magistrate I. Jallow, in a ruling delivered on Thursday, August 7, granted the bail application filed by Defence Counsel K. Bojang on behalf of his clients, Muhammed Krubally and Muhammed Jawo. The two accused are charged with “indecent practice between males” under Section 147(1) of the Criminal Code, Cap 10:01 Vol. III, Laws of The Gambia, 2009.
According to the charge, the prosecution alleged that on 18 May 2025, at Old Yundum in the West Coast Region, Krubally and Jawo were found engaging in a sexual act, specifically performing oral sex on each other, an act described in the charge sheet as “gross indecency.”
Delivering her ruling, Magistrate Jallow said the court was satisfied with the bail application and granted each of the accused persons bail in the sum of D500,000.
She ordered that each accused must provide two Gambian sureties, who are required to submit affidavits of means and deposit their valid national identity cards with the court. The sureties must also enter into a recognizance to ensure that the accused persons appear in court whenever required.
In addition to those conditions, each accused person must submit a title deed for a property with a value equal to or exceeding the bail sum of D500,000.
“The purpose of bail is to secure the attendance of the accused persons, and the court is satisfied that the conditions set forth will achieve that,” Magistrate Jallow stated.
