Man Accused of Mutilating Ivorian with Cutlass Appears at Brikama Magistrate Court

A man accused of mutilating the hand of one Mr. Rowoang Nwachukwu, an Ivorian national with a cutlass has appeared before Magistrate Fatou Darboe of theBrikama Magistrate’s Court.

The incident, which resulted in grevious bodily harm, took place in  Kembujeh village in the West Coast Region on 27 December 2023,

On Tuesday 9January 2024, when the case was called, Police Prosecutor Sub-inspector Masaneh Fadera appeared for the Inspector General of Police, while the accused person Mr. Muhammad Ndaw, appeared unrepresented. A charge sheet was read to the accused person in court in English,to which he pleaded ‘not guilty’.

Police prosecutor Sub Inspector Fadera in his submission objected to the granting of a court bail to the accused person.

However in her ruling, Magistrate Darboe granted bail to the accused person in the sum of D75,000.00, and ordered him to produce  three Gambian sureties who should sign a bond of D25,000, with the third surety who must be a Police Officer with the rank of a Sergeant.

The statement of offence in this case indicates the commitment of grevious bodilyharm by the accused person on the witness, contrary to Section 214 of the Criminal Code,Cap 10:01; Vol 111; Laws of the Gambia 2009, and the particulars of offence indicate that Muhammad Ndow, on the 27th day of December 2023 in Kembujeh village in the West Coast Region of the Republic of the Gambia, unlawfully assaulted one Mr. Rowoang Nwachukwu by chopping his right leg, right ear and right hand,causing him grevious bodily harm and thereby committed an offence under the laws of the Gambia. 

At this juncture, the case was then adjourned to Tuesday, 16 January 2024,for the continuation of hearing.
