Does the Executive have any role of mitigation in judicial proceedings?
The answer is in the positive.
Even though the separation of powers is an ideal doctrine, there are lapses in jurisdiction when it comes to the powers of the executive and the judiciary. The Attorney General and Minister of Justice is part of the Executive, however, there are certain charges relating to public order which cannot be presided over by a judge unless the fiat or authorization of the Attorney General is sought.
In the same vein, the Attorney General could intervene to facilitate the discharge and release of accused persons at any stage of criminal proceedings.
It is Foroyaa’s conviction that if there is any situation that deserves intervention to terminate proceedings, the cases dealing with the April 14 and 16 incidents should rank the highest.
The Executive should take note and remain focused in order to manage and resolve political conflict.
