WHY IS TINA FAAL STILL DETAINED AT MILE 2?

The situation of Tina Faal is again questioning the protective powers of the courts. The magistrates’ court has granted bail and the prosecution has told the court that he was not aware of any re-arrest. He is also not charged. The high court has authority to hear cases of unlawful arrest and detention.

The case of Imam Sawaneh however does not give much encouragement to family members and friends who may wish to go to the high court to address the problems.

It is therefore important for the state to give the respect and assistance to the courts to enable the institution to deliver to serve as an institution of protection. Once the state fails to cooperate with the institution, justice will not be done.
