As reports are received of the leaving of passengers who were kept in a hotel for observation after they disembarked in The Gambia on their way to Senegal the question of the legality of detention and the banning of gatherings without a declaration a state of emergency comes to the fore. The Attorney general needs to issue a Press statement to explain the legality of the emergency measures to address COVID 19 which are encroaching on certain fundamental rights and freedoms with a degree of complicity with Parliament and the general public due to the seriousness of the Pandemic. Notwithstanding, legality should not be compromised before the altar of a Pandemic.
