Two young men, Muhammad Jawo and Muhammad Krubally, are standing trial before Magistrate I. Jallow of the Brusubi Magistrates’ Court, sitting at the Bundung Court premises, for allegedly engaging in homosexual activity in an unfinished building in Old Yundum.
The two accused persons were arraigned on Tuesday, 5th August 2025, on a charge of indecent practice between males, contrary to Section 147(1) of the Criminal Code, Cap 10:01 Vol. III, Laws of The Gambia 2009.
According to the particulars of the offence, on the 18th day of May 2025, at Old Yundum in the West Coast Region, the accused persons were allegedly found engaging in acts of gross indecency by performing oral sex on each other.
Testifying as the first prosecution witness, PIU officer Momodou Sanyang told the court that on the evening of 18th July 2025, he was posted at the residence of the Minister of Interior. Around 9:35 p.m., he sought permission from his guard commander, Basiru Sarjo, to patrol the area.
While on patrol, Officer Sanyang said he observed a boy standing near a fence, appearing to watch a particular compound. He said he hid himself and observed the boy, who eventually jumped into the compound. Sanyang said he followed the boy, confronted him, and was told that two individuals had jumped into the compound before him.
Upon entering an incomplete building on the property, Officer Sanyang testified that he found the second accused, Muhammad Jawo, lying on his back with his underwear removed, while the first accused, Muhammad Krubally, was performing oral sex on him. “That was the moment they jumped through the window and I arrested them,” he told the court. “Before arresting them, I asked Muhammad Jawo to put on his underwear which was lying on the ground.”
He said he took both accused persons to the PIU guard post and reported the matter to Commander Sarjo. With the assistance of Sanneh, a driver at the Minister’s residence, the suspects were transported to the Banjulinding Anti-Crime Unit, where they were handed over and statements were taken.
Inspector L. Gomez, who represented the Inspector General of Police, asked the witness to clarify what he saw. In response, Sanyang repeated that he found the first accused, Muhammad Krubally, performing oral sex on the second accused, who was lying on his back.
The case has been adjourned to 7th August 2025 for cross-examination by Defence Counsel K. Bojang.
