Lawyer Lamin K. Mboge yesterday, 22nd October, 2014 applied to the court to
adjourn the matter in order to regularize the content of his appeal before the Brikama High Court during a proceeding of a criminal trial involving Sheikh Muhideen Hydara, the Caliph General and Mr. Buyeh Touray, the Alkalo respectively, from Darsilameh Sangahor, in the Foni Kansala district, West Coast Region.
The state was represented by Alieu Jallow whilst Lawyer Lamin K. Mboge appeared for the accused persons.
Lawyer Mboge in a congested court room said they have summon before the high court dated 17th September, 2014 and this was filed the same day.
He added that “the summons’s prayers included the stay off proceeding in the Brikama Magistrate Court in the case of IGP versus Muhideen Hydara and Buyeh Touray pending the hearing of the case before this court. The application is supported by 14 paragraphs and two Exhibits (MB1 and MB2). I rely on all these paragraphs in the affidavit and the Exhibits to support my application.”
He further stated that there is a criminal case pending at the Brikama Magistrate’s Court in which paragraph 6 of the affidavit stated that the accused persons are charged with conspiracy to commit felony and disobedience to a lawful order. He said as at the time of filing this appeal, it was only one witness who testified.
At this juncture, he was asked by the Judge to name the magistrate who made the ruling that led the defence to apply at the high court. The defence counsel could not recall the identity of the magistrate.
He therefore applied for an adjournment to enable him to regularize the content of the appeal at the high court with necessary information. There was no objection made by the state counsel.
The trial judge at this juncture, adjourned the matter to Wednesday, 29th October, 2014 at 12pm for the defence to regularize and put their house in order.
