Momodou Sabally, the campaign manager of the United Democratic Party (UDP) has been unconditionally released by the police on Friday afternoon.
The breakthrough, according to Sabally’s lawyer came after the Supreme Islamic Council intervened to secure his release.
The information Foroyaa gathered is that Sabally was picked up at the PIU headquarters in Kanifing at 08:38 am by one Pa Alieu Jawara of the Special Investigations Department of the Gambia Police Force and was transported to the police headquarters in Banjul where he was released unconditionally.
Lawyer Abdoulie Fatty, counsel for Sabally was contacted by Foroyaa and he confirmed the release of his client. Lawyer Fatty explained that he received a phone call that Sabally was released following the intervention of the Supreme Islamic Council.
The Senior Lawyer welcomed the release of his client from police custody, but he expressed dismay over the violations of his client’s fundamental rights and hinted that they may take up legal action for the alleged rights violations.
“I am very happy that my client has been released unconditionally but I am not happy about the violations of his rights,” Fatty said.
Fatty said he will have a discussion with his client on the violation of his fundamental right and they may institute a case at the high court for the deprivation of his right after he was detained beyond 3 days. Equally, he said Sabally was also denied access to his lawyer.
“The law that was actually invoked to seek his continued detention we may contest the constitutionality of that to protect other Gambians from similar fate it will be appropriate to challenge this in court and get declarations on some of these issues not for Sabally, but for other Gambians,” he said.
Mr. Fatty also urged Gambians to speak up against injustice and work together to stop injustice.
