Justice O. Otaba of the Special Criminal Division of the Banjul High Court has yesterday exercised his discretion in favour of Mr.
Madun Sanyang, by granting bail to him in the sum of 900,000 US Dollars.
Mr. Sanyang alongside Sira Wally Ndow-Njai, Momodou O.S Badjie, Fafa Sanyang, Cherno Marena, Seedy Kanyi, Muntaga Momodou Sallah, Momodou Faal, Louie Moses Mendy and Noah Touray are jointly charged with economic crimes, conspiracy to commit felony, neglect of official duty, disobedience of statutory duty and destroying evidence, they however deny any wrong doing.
When the case was called Lawyers Antouman A.B.Gaye, Omar M.M Njie and Combeh Gaye appeared for Mrs.Ndow-Njai, Lawyer Ebrima Sanneh for Mr. Badjie , Mr. Fafa Sanyang, Mr. Kanyi, Mr. Mendy, Mr. Touray and Madun Sanyang. Lawyers Hawa Sisay-Sabally, Yassin Seneghore and B. Bouye appeared for Mr Marena. Lawyer E. Chime appeared for Mr Sallah and Lawyers C.E Mene S. Taal and S. Sillah for Mr.Faal. The state was represented by B. Jaiteh.
Delivering his ruling on the bail application, Justice Otaba said the applicant is charged with one count of Economic Crime and one count of Conspiracy to commit felony.
He said the state (the respondent) also filed an affidavit opposing the bail application of the applicant. He held that he had perused the reliefs sought by the applicant especially, paragraphs 6-15 and the briefs filed by both parties.
Justice Otaba, noted that the charges the applicant is charged with are all bailable. He consequently exercised his discretion in favour of the applicant and granted him bail in the sum of $900,000(Nine-Hundred Thousand US Dollars) with two Gambian sureties having landed property in like sum and he further ordered the applicant to submit his travelling documents to the Principal Registrar of the High Court and ruled that the applicant enters into a recognizance.
At this juncture, State Counsel Jaiteh told the court that their witness is engaged in a security duty throughout the length and breadth of the country. He applied for the matter to be adjourned till 22 December, 2016.
Without any objection from the defence team, Justice Otaba granted the application and adjourned the case to the above mentioned date at 11am for continuation of hearing.
