Lang Tombong & Sajor Fofana’s Case Adjourned Sine Die

The Supreme Court of The Gambia presided over by a panel of five judges Lang Tombong Tambaheaded by the Chief Justice, Justice Ali Nawaz Chowhan,   yesterday 11th of November 2014, adjourned the appeal case of the former Chief of Defence Staff of the Gambia Armed Forces Lt. General Lang Tombong Tamba, and ex- Commander of naval staff, Rear Admiral Sarjo Fofana sine die.

Both appellants are challenging the decision of the trial court ( High Court)  which convicted and sentenced them for treason.

Upon their conviction and sentenced by the said court, both appellants filed an appeal before the Gambia Court of Appeal against their conviction and sentenced by the trial court in Banjul but the criminal appeal suit was dismissed.

When the case came up yesterday, counsel for Mr. Tamba, Sheriff Tambadou, told the court that he has filed the appellant statement of case and  a motion for the grounds of appeal dated 10th of this month to be amended.

“I urged the court to grant the amendment sought,” he submitted. He added that the court has the powers to do so under the judges’ rules.

The Director of Public Prosecutions (DPP), Hadi Saleh Barkun, did not object to the said motion.

The court therefore granted him 21 days to file a reply on the amendment of statement of case.

Both appellants filed their appeal separately but the defence lawyers, Sheriff Tambadou and Lamin Mboge together with the prosecution have agreed for the matter to be consolidated upon request by the court.

The court therefore ruled that since the facts of the case are the same, they can be taken up together and consequently adjourned the case sine die.
