Reports reaching this medium intimated that the Diamond Properties was sued by one Roddie Cole and the court has delivered judgment in favour of the Plaintiff but prior to the case, the said Estate Agency sold leased properties to different individuals at Old Yundum who were surprised to be told by officials from the Sheriff Division that they should pay D150, 000 each or else lose their properties.
For this reason, some complainants appeared at Foroyaa with tears for fear of losing their properties. According to one of the complainants, he got his plot since 2013 at a tune of D110, 000 and is already living there but to his surprise, he was asked to vacate his home as the High Court in Banjul has given powers to one Bakary Darboe to sell the whole place. He said he has valid documents regarding ownership of that property.
Another Complainant reveals that upon meeting the Sheriff of the High Court, she was told that the MD of Diamond Properties had a case with someone and judgment was delivered against him. She added that she has valid documents showing ownership of two plots in Old Yundum bought at a tune of D250,000 each. Another complainant added that his father bought three plots from the said Agency.
It is for these reasons that this reporter contacted the Sheriff Division of the High court for clarity. According to the Sheriff of the High Court, Sheriff Tabally, when he assumed office he found the whole property subjected,since 2013 to the enforcement of a judgment delivered by both the High Court and Court of Appeal respectively which was never challenged by the defendant (Diamond Properties).
“The only places that are sold are empty plots for now. Those that have already developed theirs are urged to pay D150, 000 in order to retain a plot.” Upon payment in our Central Bank Account, they come with their receipts and we issue them authentic certificate of ownership,” he clarifies.
The following questions are still outstanding:
Has Diamond properties regularized all documents of ownership received from diamond from the company to make them authentic?
Was there an agreement between the Plaintiff (Roddie Cole) and the Defendant (Diamond Properties) for the defendant to be paying him the monies owed to him on instalment?
But the defendant breached the agreement,therefore prompting his office to sell the property to enable the Plaintiff to recover his monies?
How does Diamond Properties intend to protect those who bought its properties?
This reporter will conduct more investigation to get to the truth.
